C\u2019\u00e8 un\u2019importante novit\u00e0:\u00a0l<\/strong>e Italian companies exporting goods to Germany must comply, as of July 1, 2022, with a<\/strong>\u00a0new legislation\u00a0<\/strong>which provides for greater control regarding the packaging system.<\/p>\n

The law has been in place for some time but officially came into effect just a few days ago, and there are still a number of companies grappling with this news.<\/p>\n

This is a change that can have a great impact and it is necessary to move now. Companies that fail to come into line with the new regulations are at great risk: there are both\u00a0the ban on sales in Germany<\/strong>, both of the\u00a0fines<\/strong>\u00a0that can arrive\u00a0up to 200,000 euros<\/strong>.<\/p>\n

Regulatory obligations are an update of the\u00a0law VerpackG<\/strong>, entrata in vigore nel 2019 con l\u2019obiettivo di rafforzare il sistema di riciclo degli imballaggi: mentre prima riguardavano solamente il settore B2C, dal 1\u00b0 luglio 2022 riguardano anche il settore B2B. In questo modo l\u2019intera filiera dell\u2019esportazione sar\u00e0 coinvolta,\u00a0including the e-commerce channel.<\/strong><\/p>\n

\u00a0<\/p>\n

The rules provided for packaging in Germany<\/h2>\n

\u00a0<\/p>\n

It is planned to register all packaging (in addition to sales and secondary packaging, see VerpackG) with the Lucid portal of the Central Packaging Registry Zentrale Stelle Verpackungsregister:
\n\u2013 Imballaggi da servizio;
\n\u2013 Imballaggio da trasporto;
\n\u2013 Imballaggi commerciali\/industriali (ambito B2B);
\n\u2013 Imballaggio da vendita incompatibile con il sistema;
\n\u2013 Imballaggio da vendita di prodotti da riempimento contenenti sostanze inquinanti;
\n\u2013 Imballaggi riutilizzabili;
\n\u2013 Imballaggi per bevande monouso con obbligo di deposito (Pfand).<\/p>\n

\u00a0<\/p>\n

Obligation to provide statement of participation in the system<\/h3>\n

\u00a0<\/p>\n

All manufacturers and distributors (Erstinvehrkerbringer) of packaging subject to legislative obligations must Provide a statement about their participation in the system at the time of registration<\/strong> o Declare that they only market packaging that already participates in the system, i.e.:
\n\u2013 prima di immettere gli imballaggi sul mercato;
\n\u2013 in mancanza di dichiarazione, si applica un divieto di distribuzione; questo divieto si applica anche ai marketplace online e ai fornitori di servizi di spedizione;
\n\u2013 per mezzo di una lettera informale che dichiara il trasferimento anticipato della partecipazione al sistema (imballaggio del servizio), che deve essere presentata solo una volta durante la registrazione.<\/p>\n

Obligation of marketplace operators and packaging distribution and filling centers<\/h3>\n

\u00a0<\/p>\n

Marketplace operators and distribution and filling centers must ensure that packaged merchandise sold through their platform complies with their obligations under the VerpackG Act: registration of producers to the Lucid portal and participation of packaging in a dual disposal system.
\n<\/strong><\/p>\n

To this end, a (electronic) comparison of the data with information accessible to the Lucid Public Packaging Registry is sufficient<\/strong>. First placing on the market without prior participation in the system is therefore a violation of obligations and is subject to fines.<\/p>\n

What to do now?<\/strong><\/em><\/h2>\n

\u00a0<\/p>\n

Don't waste time.<\/strong>\u00a0As just shown, Italian companies need to adapt as soon as possible\u00a0enrolling in the registry\u00a0<\/strong>LUCID<\/a><\/strong>\u00a0for all\u00a0packaging in Germany, not only B2C, but also B2B,<\/strong> thus avoiding unpleasant surprises.<\/p>\n
